Aquick brief on the content of a master’s degree in law entitled:
”The impact of death of the expiry of the legal personality of the person”
(a comparative study of Islamic law).
Introduction: Ahmed Gaber Mohamed Mahmoud.
I showed in these pages a subject has a lot of controversy around it because of its importance, namely death. So it became obliged to show the Islamic, medical and legal concept of death.
This was in the first chapter of the message study.
And then came the second chapter entitled ”the extent of the expiaration of the legal personality by death”.
In which I showed the impact of real death on the expiry of the legal personality in the Islamic law and in the Egyptian law. And then the impact of death caused by court’s decision on the expiry of the legal personality the Islamic law and the Egyptian law.
Then concluded this chapter with the impact of brain death of the expiry of the legal personality in Islamic law and Egyptian law.
And ended up in this part after showing all views that the death of brain stem doesn’t be considered real death and doesn’t cause the provisions of death like : washing, shrouding, burial, inheritance and kit.
And finally comes the third chapter entitled: ”The implications of the expiry of the legal personality by death”.
Indicating these effects on money and financial obligations and then on the wife in both of the Islamic law and the Egyptian law.
