المستخلص This thesis dealt with the role of the Supreme Constitutional Court in establishing the principles of justice, comparative study. The thesis is divided into two parts, where it dealt with in the first section of what justice and its elements, characteristics and to distinguish between the concept of justice, and mingle with the concepts and the role of the Supreme Constitutional Court in establishing the principles of justice. A statement on justice in Islamic jurisprudence and legal positivist and guarantees the establishment of the principles of justice, which is in the principle of legality and the principle of separation of powers and judicial control over the work of the administration and then we dealt with in second Part, the role of the Supreme Constitutional Court and the principle of criminal justice in the protection of the rights and freedoms, so we divide it into two chapters we discussed in the first chapter, human rights in the philosophy of the Supreme Constitutional Court and its role in protecting the rights and freedoms of political, economic, social, and finally we had dealt in the second chapter with criminal justice as one of the most important mechanisms for achieving justice in terms of the emphasis on the principle of equality before the courts and the principle of the presumption of innocence and the right to a fair trial and freedom of prisoners. |
