Abstract
The study Deal with the subject of civil liability for the role of nurseries in Egyptian, Jordanian and some Arab countries law through four sections. the first section was a preliminary section and bout introduction for nurseries , its general framework and its Social importance.
The second chapter explained the role of the nursery and talked about its objectives and the substantive and procedural conditions to create nurseries where show that the Deficiencies and negligence in the application of security and safety standards as result of absence of supervision by the authorities . then we talked about the difference between nurseries and other similar systems, their main problems and how to face.
Chapter three of the study talked in detail about civil liability for damage caused by the operation of custody, both contractual and tort, where the searcher found that there is substantial commitments not imagine the existence of the contract without a commitment to ensure the safety of the little boy, where he became this commitment represents a fundamental principle forms the basis for many of the commitments.
Finally, third chapter of this study talked about the effects of liability of nurseries and liability lawsuit which arised from the breach of this liability. after that, the chapter reviewed the provisions of the compensation claim and the right of the children or his authorized representative to choose between contractual or tort liability of the nursery if its break based on fraud or error or a criminal offense.
