Abstract
Civil liability insurance is a contract between a person called the insured and another person called the insured, according to which the insurer bears the financial burden resulting from the harmful risk due to the return of others to the insured for liability, in exchange for the installments paid by the latter. One of the ideas widely spread in the law is the idea of insurance being linked to risk. Insurance is not legislated except in order to confront some danger, and the danger in our case here is the medical liability in any of its forms. It stipulates that the injured person must prove the fault of the responsible, which may be difficult proof, and even if the evidence is imposed and the judgment to compensate the injured, he may not be able to implement his judgment due to the delay or insolvency of the official, and accordingly the best way to guard against liability in the medical field is to insure against liability. Based on that, we dealt with the issue of civil liability insurance in the field of medical work in two sections that we paved with an introductory chapter entitled the idea of a medical civil liability insurance contract. The pillars of civil liability in the medical field, and in the second chapter compulsory insurance and the scope of the risk insured from, and in the second section we dealt with the effects of insurance from civil liability in the field of medical work and was divided into two chapters. The second is compensation for medical risks.
